In order to limit the spread of the Coronavirus SARS-CoV-2, the SIPO adopted special measures valid as of 29 March 2020 until further notice.
Substantive and procedural time limits have been suspended during the validity of said Act, including time limits for filing oppositions and maintenance of rights, except in urgent cases.
The Office specified the following matters as urgent:
- Office Actions relating to patent application requests,
- Issuance of Priority Documents for patents, trade marks and designs,
- Office Actions relating to trade mark registration requests,
- Office Actions relating to design registration requests.
The time limits for the enforcement of rights, with the exception of the above-specified urgent cases, shall be extended to expire on the eighth day after the termination of the measures.
In case of an urgent matter where the deadlines run, the Office will issue a notice stating that the deadline has not been interrupted and will continue. We will inform our clients in such cases.
Requests are to be submitted electronically. Currently, a scanned Power of Attorney is sufficient. The exception relates to documents in relation to the above-identified urgent matters.
Documents such as Office Actions, orders, decisions will be served by the Office upon termination of the measures.
The Office recommends the payment of maintenance fees as they fall due.
The time limits relating to court proceedings and the time limits in judicial matters have been suspended.
