Subject-matter of industrial design protection: industrial design registered for a design to the extent that it is new and has an individual character; wherein design means the appearance of the whole or a part of a product resulting from the features of, in particular, the lines, contours, colours, shape, texture and/or materials of the product itself and/or its ornamentation; wherein product means any industrial or handicraft item, including, inter alia, parts intended to be assembled into a complex item, packaging, get-up, graphic symbols and typographic typefaces, but excluding computer programmes
Exceptions to industrial design protection: appearance of the product shall not be registered:
• if it includes or imitates badges, emblems or escutcheons which are of particular public interest, unless the consent of the competent authorities to its registration has been given;
• if it is contrary to public order or morality;
• for the features of appearance of a product, which are solely dictated by its technical function;
• for the features of appearance of a product, which must necessarily be reproduced in their exact form and dimensions in order to be mechanically connected to another product
Several designs application: possible provided they belong to the same class of the Locarno International Design Classification
Transformation of the design into a patent or vice versa: not possible
Examination: only formal examination, no substantial examination
Publication and registration: shortly after the filing design is published and registered; deferment of publication possible so as to up to 12 months
Term of the design: 25 years from the filing date
